- Intent-to-use basis - Section 1(b) No use evidence is required at the time of filing, but use evidence and additional fees will be required at the registration stage.
Use Evidence for Trade Mark Applications in the US
- For Classes 1–34 : Submit photos showing the trade mark on the product or its packaging. The trade mark as shown must match exactly with the one filed with the USPTO.
- For Classes 35–45 : Submit signage photos or website screenshots including the domain URL.
Amazon Brand Registry
- To list your brand on Amazon, you must provide a trade mark application or registration certificate from a country recognised by Amazon. (Note: Applications that are later refused will become invalid.)
- Please note that applications via WIPO (Madrid system) are not accepted for Amazon Brand Registry.
- We recommend filing in any country where a certain level of sales is already taking place.
